Assigned Counsel and Attorney for Children Panels throughout New York State, from Brooklyn to Rochester, Erie to Washington County, have not seen a raise in their rate of pay since 2004, for over 18 years. This has made it impossible to attract and retain qualified attorneys to do this important work. These attorneys represent children and the indigent in family, matrimonial, criminal and appellate cases. They represent people who have liberty interests in jeopardy of being taken away, whether it be to protect a person from an abuser, defend a person’s due process rights, or ask for a review of a lower court decision that may have been made in error. These are all rights that are upheld by the Constitutions of the United States and the State of New York. In 2003, Hon. Lucinda Suarez ruled that the stagnant rate of pay was unconstitutional as applied to the representation of children and indigent adults. In 2022 we find ourselves in the same position as we were in back in 2004 – a rate of pay that has not been increased by the legislature in close to two decades. This CLE will examine the legal history, relevant case law, and statutory basis of the assigned counsel compensation legislation, the impact that the inaction to increase assigned counsel rates is having on our children, families and indigent adults, and what steps the Assigned Counsel Association, NYS, Inc., in unity with NYC Bar Associations, have taken to bring legal action against the State and Counties.

On June 21st, 2023, WBASNY’s Title IX & Education Committee will present a webinar CLE entitled The Changing Landscape and Contemporary Issues in Title IX. The CLE features Thomas McDonald, Esq., Assistant Director of Employee and Labor Relations at the Research Foundation of the City University of New York. Mr. McDonald has 30 years of experience in the Title IX space and he will present a history of Title IX as it relates to sexual harassment on college and university campuses. Mr. McDonald will discuss relevant Title IX definitions; Title IX investigation and hearing procedures and timelines; standards of burden of proof; alternatives to on-campus reporting; remedies if a college or university does not have jurisdiction; and resources for students and employees. He will cover the proposed Biden Administration Title IX Regulations and the impact of the proposed regulations, guidance and procedures on complainants, respondents, and educational institutions. Mr. McDonald will discuss contemporary issues in Title IX protections, including issues impacting the LGBTQA+ community and issues arising in the scope of transgender students in athletics at the collegiate/middle and high school levels.
